Suffering of illness by the patient after surgical procedure does not mean medical negligence

A doctor can be held responsible for medical negligence only if the suffering of any such disease is because of the surgery was improperly done and that also with the degree of negligence on the part of the doctor.

The Hon’ble Supreme Court of India, vide judgement dated 01.10.2018, in the matter titled as “Dr. S. K. Jhunjhunwala versus Mrs. Dhanwanti Kumar & Anr.”, said that merely showing the suffering of illness by the patient after a surgical procedure does not sum to medical negligence.
